Agreement to Terms

By accessing or using FixMyMessage.com and its associated mobile applications (collectively, the "Service" or "Licensed Application"), you agree to be bound by these Terms of Service ("Terms" or "EULA"). If you do not agree to these Terms, please do not use the Service.

Important Notice: This End-User License Agreement is concluded between you and FixMyMessage ("Developer," "we," "us," or "our") only, and not with Apple Inc. ("Apple") or Google LLC ("Google"). The Developer, not Apple or Google, is solely responsible for the Licensed Application and the content thereof.

We reserve the right to modify these Terms at any time. Your continued use of the Service following any changes constitutes your acceptance of the revised Terms.

Scope of License

The license granted to you for the Licensed Application is limited to a non-transferable license to use the Licensed Application on any Apple-branded or Android products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions or Google Play Terms of Service. The Licensed Application may be accessed and used by other accounts associated with the purchaser via Family Sharing, volume purchasing, or similar features where available.

Description of Service

FixMyMessage provides an AI-powered grammar checking, spell checking, and text improvement service. The Service analyzes text you submit and provides suggestions for corrections and improvements using artificial intelligence technology.

Content Disclaimer and User Content Responsibility

YOU ACKNOWLEDGE AND AGREE THAT FIXMYMESSAGE IS NOT RESPONSIBLE FOR ANY CONTENT SUBMITTED, PROCESSED, OR GENERATED THROUGH THE SERVICE. THIS INCLUDES:

• User-Submitted Content: You are solely responsible for all text, messages, and other content you submit to the Service. We do not endorse, verify, or assume any responsibility for user-submitted content.
• AI-Generated Suggestions: All suggestions, corrections, and improvements provided by the Service are generated by artificial intelligence and are provided without any guarantee of accuracy, appropriateness, or fitness for any purpose.
• Third-Party Content: We are not responsible for any third-party content, links, or materials that may be referenced or suggested by the Service.
• Consequences of Use: Any outcomes, consequences, or damages arising from your use of AI-generated suggestions in your communications are solely your responsibility.

WE EXPRESSLY DISCLAIM ANY AND ALL LIABILITY FOR THE CONTENT OF MESSAGES, THE ACCURACY OF AI SUGGESTIONS, AND ANY HARM THAT MAY RESULT FROM YOUR RELIANCE ON OR USE OF SUCH CONTENT.

AI-Generated Content Disclaimer

The Service utilizes artificial intelligence to generate suggestions and corrections. You acknowledge and agree that:

• AI-generated content may contain errors, inaccuracies, or inappropriate suggestions. The AI is not infallible and may produce incorrect or misleading results.
• You are solely responsible for reviewing, verifying, and approving any suggestions or corrections before using them in your communications.
• We do not guarantee the accuracy, completeness, reliability, or suitability of any AI-generated content for any particular purpose.
• The Service should not be relied upon as the sole means of proofreading for critical, legal, medical, financial, or other high-stakes communications.
• AI suggestions are provided "as-is" and may not account for context, tone, cultural nuances, or specific requirements of your intended audience.

User Responsibilities

By using the Service, you agree to:

• Use the Service only for lawful purposes and in accordance with these Terms.
• Not submit content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
• Take full responsibility for any content you submit and any actions you take based on AI-generated suggestions.
• Not attempt to reverse engineer, decompile, or otherwise extract the underlying algorithms or models.
• Not use the Service to generate spam, phishing content, or other malicious communications.
• Comply with all applicable third-party terms of agreement when using the Service (e.g., your mobile carrier's data service agreement).

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FIXMYMESSAGE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses.
• Any damages arising from the use or inability to use the Service.
• Any damages resulting from AI-generated content, suggestions, or corrections provided by the Service.
• Any errors, inaccuracies, or omissions in the content produced by the Service.
• Any unauthorized access to or alteration of your transmissions or data.
• Any third-party content or conduct related to the Service.
• Any damages resulting from reliance on AI-generated suggestions in personal, professional, legal, medical, or financial contexts.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE AMOUNT YOU PAID TO US, IF ANY, FOR ACCESS TO THE SERVICE DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Disclaimer of Warranties

THE SERVICE AND LICENSED APPLICATION ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, FIXMYMESSAGE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Warranties that the Service will be uninterrupted, timely, secure, or error-free.
• Warranties regarding the accuracy, reliability, or quality of any content obtained through the Service.
• Warranties that any errors in the Service will be corrected.
• Warranties that the Service will be compatible with any other software, systems, or services.
• Warranties that any results obtained from use of the Service will be accurate, reliable, or meet your needs.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOU USE THE SERVICE AND LICENSED APPLICATION AT YOUR OWN RISK AND DISCRETION. We do not warrant that the AI-generated suggestions will meet your requirements or expectations. Any material downloaded or otherwise obtained through the use of the Service is accessed at your own discretion and risk, and you will be solely responsible for any damage to your device or loss of data that results from the download of any such material.

Apple App Store Users: In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be FixMyMessage's sole responsibility.

Indemnification

You agree to indemnify, defend, and hold harmless FixMyMessage, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service.
• Your violation of these Terms.
• Your violation of any rights of another party.
• Any content you submit through the Service.
• Your use or misuse of AI-generated suggestions or content.

Intellectual Property

The Service, including its design, features, and content (excluding user-submitted content), is owned by FixMyMessage and is protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any content you submit to the Service. By submitting content, you grant us a limited license to process your content solely for the purpose of providing the Service.

Intellectual Property Infringement: You acknowledge that, in the event of any third party claim that the Licensed Application or your possession and use of the Licensed Application infringes that third party's intellectual property rights, FixMyMessage, not Apple or Google, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.

Subscription and Payments

Certain features of the Service may require a paid subscription ("Premium Features"). By subscribing, you agree to the following terms:

Subscription Terms

• Subscriptions are billed in advance on a recurring basis (weekly, monthly, or annually, depending on the plan selected).
• Subscriptions will automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
• Your account will be charged for renewal within 24 hours prior to the end of the current billing period.
• You can manage and cancel your subscription through your Apple App Store or Google Play Store account settings.

Free Trials

• If a free trial is offered, your subscription will automatically convert to a paid subscription at the end of the trial period unless cancelled.
• Any unused portion of a free trial period will be forfeited when you purchase a subscription.

Pricing and Taxes

• Subscription prices are displayed in your local currency and may vary by region.
• You are responsible for all applicable taxes associated with your subscription.
• We reserve the right to modify subscription pricing with reasonable notice. Price changes will apply to subsequent billing periods.

Refunds

• Refunds are handled according to the policies of the respective app store (Apple App Store or Google Play Store).
• For subscriptions purchased through the Apple App Store: In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the Licensed Application.
• For subscriptions purchased through Google Play Store: Refund requests are subject to Google Play's refund policies.

Cancellation

• You may cancel your subscription at any time, but cancellation will take effect at the end of the current billing period.
• No refunds or credits will be provided for partial subscription periods.
• Upon cancellation, you will continue to have access to Premium Features until the end of your current billing period.

Maintenance and Support

FixMyMessage is solely responsible for providing any maintenance and support services with respect to the Licensed Application, as specified in these Terms or as required under applicable law. You acknowledge that Apple and Google have no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.

Product Claims

You acknowledge that FixMyMessage, not Apple or Google, is responsible for addressing any claims by you or any third party relating to the Licensed Application or your possession and/or use of the Licensed Application, including, but not limited to:

• Product liability claims;
• Any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement;
• Claims arising under consumer protection, privacy, or similar legislation.

Legal Compliance

You represent and warrant that:

• You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country;
• You are not listed on any U.S. Government list of prohibited or restricted parties.

Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease.

Third Party Beneficiary

You acknowledge and agree that Apple, and Apple's subsidiaries, are third party beneficiaries of these Terms (as they relate to use of the Licensed Application on Apple devices), and that, upon your acceptance of the terms and conditions of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third party beneficiary thereof.

Similarly, Google LLC is a third party beneficiary of these Terms as they relate to use of the Licensed Application on Android devices.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which FixMyMessage operates, without regard to its conflict of law provisions.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
